CARES Act, Title IX and 504 Compliance

Mackintosh Academy (Mackintosh Academy Boulder and Mackintosh Academy Littleton) is fortunate to have received a CARES Act (PPP) small business loan to help assist our school during this period of economic downtown. The loan is forgivable and will turn into a grant once the requirements of the loan have been met. We are anticipating this happening in July.

As part of receiving CARES act PPP funding, Mackintosh Academy is subject to Title IX* and partial 504** regulations during the interim period before our loan is forgiven. As a result, we have appointed Anita Deshommes, Mackintosh Academy Boulder Business Manager, as the Title IX and Section 504 administrator and Arleen Brogan-Smith, Mackintosh Academy Littleton Business Manager, as Deputy Administrator during this time.

They will be conducting a self-assessment of current nondiscrimination policies and filing required compliance documents with the Department of Education as part of this process. They will also respond to any allegations of discrimination or harassment.

Once the loan has been forgiven, the requirement for us to have an official Title IX/Section 504 administrator will be removed. We are however committed to ensuring that we continue to have administrators that monitor and respond to any potential discrimination or harassment issues, and they will continue in the role as part of their duties as Business Managers.

*Title IX is a federal civil rights law in the USA that was passed as part of the education amendments in 1972. It states “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”

**Section 504 of the rehabilitation act of 1973. Like the Americans with Disabilities Act (ADA) which we are already covered under, Section 504 relates to ensuring individuals are not subject to discrimination under any program or activity receiving Federal financial assistance.
